What to Know About HOAs in San Diego County Before You Buy (2026)
Many San Diego County homes—especially condos, townhomes, and master-planned communities in places like Carlsbad, San Marcos, Oceanside, and beyond—are part of a common interest development (CID). California’s Davis-Stirling Common Interest Development Act sets disclosure duties when a separate interest is sold. Your job as a buyer is to read the packet and use your contract contingencies while you still can.
Why HOA due diligence matters
- Assessments affect affordability as much as the mortgage rate.
- Rules can block your intended use (rentals, short-term stays, parking, pets, ADUs—whatever the documents say).
- Underfunded reserves raise the odds of special assessments.
- California cancellation timing is driven largely by your purchase contract and delivery of required disclosures—not a single Nevada-style five-day HOA statute—so calendar every contingency.

What You Should Receive
For many residential CID resales, Civil Code provisions (including the document list associated with Civil Code §4525 and delivery rules such as §4530) require the seller/association pathway to provide governing documents, financials, assessment information, and related disclosures. Expect CC&Rs, bylaws, operating rules, the budget, reserve materials, assessment statements, and notices of certain violations or construction-defect issues when applicable.
Associations often charge for the packet. Confirm who pays that fee in the contract. Age-restriction language, if present, must be read against current fair-housing law—your agent and, if needed, a lawyer should flag enforceability issues rather than treating marketing claims as gospel.
How Cancellation Timing Usually Works
Unlike Nevada’s specific NRS 116.4109 fifth-day resale-package right, California buyers typically rely on purchase-contract contingency periods and on statutory rights tied to delivery of transfer disclosures (for example, Civil Code §1102.3 timing if certain disclosures arrive after you sign). Do not assume you have “five days no matter what.” Put review periods in the contract and track delivery dates.
If a disclosure arrives late, ask immediately—in writing—how your contingency clock works under the form you signed.
A Practical Review Checklist
- Current regular assessment and any approved increase.
- Special assessments levied or proposed.
- Reserve study / funding level and major projects planned.
- Insurance overview (especially for condos—walls-in vs. association master policy).
- Rental restrictions and minimum lease terms.
- Meeting minutes for disputes, noise, or deferred maintenance themes.
- Litigation involving the association.
- Parking, EV charging, ADU, and architectural rules if relevant to your plans.
Condos vs. Planned Developments
In a condo, you often own the interior airspace and share ownership of common elements; insurance and repair lines can be technical. In a planned development, you may own the lot while the association maintains shared tracts. Either way, the documents control—not the tour script.
Bottom Line
Price the HOA into your offer strategy and read the Davis-Stirling packet like a second inspection. Call or text 702-496-8216 and I’ll help you prioritize what matters for your use case.
FAQ and Practical HOA Tips (San Diego County)
Are condo questionnaires worth it?
Lenders often require them. They also reveal insurance deductibles, rental percentages, and litigation boxes that buyers should understand.
What if reserves look low?
Ask what major projects are planned and whether a special assessment is already discussed. Low reserves plus aging buildings is a red-flag combination—not an automatic deal-killer, but a pricing and reserve issue.
Short-term rentals
Coastal and tourist-adjacent communities may restrict or ban short-term rentals. Do not buy on a vacation-rental spreadsheet unless the documents and local ordinances allow your plan.
Age-restricted communities
Marketing claims about age restrictions must be checked against current law and the association’s recorded documents. Fair housing rules matter—get clarity in writing.
Timeline tip
Request the CID packet immediately after acceptance. Do not wait until the week contingencies expire. Call 702-496-8216 and I’ll help prioritize the stack.
